How hiring through an Employer of Record works in Guinea

An Employer of Record (EOR) provider is a third-party company that hires employees on behalf of foreign employers without a legal entity in Guinea. The choice to use an EOR instead of setting up a new local entity in Guinea may depend on a number of factors, including speed, complexity and cost-effectiveness. When an EOR is used, it acts as the legal employer of the worker selected by the local company. The EOR, like Rivermate, handles all employment compliance aspects in accordance with local labor legislation. The daily oversight of the employee’s work remains with the client company, as does the evaluation of their performance. The model allows companies to hire talent quickly and compliantly in an unfamiliar market where they lack local expertise.

Mandatory premiums & paid leave

Guinea defines a 40-hour workweek with overtime attracting applicable premium rates. Working hours cannot exceed 48 per week (or 10 per day) with overtime included.

Overtime is paid with a premium of 30% for the first four hours per week and 60% for all additional hours.
Work on a public holiday attracts a 60% premium (during the day) and 100% at night.
Regular work performed during the nighttime (between 21:00-05:00) is paid with a 20% premium.
Paid sick leave in Guinea is granted if the employee has worked for at least three months with a workload of at least 120 hours per month. An amount equal to 50% of their reference earnings is paid for up to 13 weeks (26 weeks in cases of at least 1 year of prior coverage, up to 52 weeks for long-term illness).
Maternity leave is paid as a joint liability of the employer and the social insurance institution (both parties pay 50%). While maternity leave must be granted to all employees, payment of the CNSS benefit depends on at least 9 months of employment prior to childbirth, and the benefit amount is calculated on the basis of the average earnings of the last three months. The benefit is payable for 14 weeks (typically 6 weeks before birth + 8 weeks after birth). For multiple births, this period is extended to 16 weeks.
Annual leave of 2.5 working days for each month is due, up to a total of 30 working days per year. The employee becomes eligible to use accrued leave after one month of service. The local employment laws also regulate that leave accrued during each year must be used within the year and prohibit payment in lieu of leave; such payment of unused leave is only allowed during termination.

Statutory employer taxes and contributions

Social security contributions

Guinea has two social security institutions; one each for the private and public sectors. While CNPSAE covers civil servants, all private sector employers must mandatorily declare each employee to the CNSS. Created in 1960, it is funded by contributions of both employers and employees.

Employees typically contribute 2.5% of their gross salary to health insurance and 2.5% to retirement, death and invalidity funds, for a total of 5% levied on the total gross salary.

On the employer side, a total rate of 18% for contributions is paid. The minimum amount on which both employer and employee contributions are calculated is GNF 550,000 (minimum guaranteed wage), while the maximum is capped at GNF 2,500,000. The 18% is distributed into four distinct funds as follows:

Contribution type Employer contribution rate
Family benefits 6%
Health insurance 4%
Occupational diseases and accidents 4%
Retirement, disability, death 4%

Employers with 20 or more employees on their payroll pay the social security contributions each month; those with a lower headcount pay contributions quarterly. Contributions (both employer and employee parts) must be paid within the first 15 days following the end of the period (month or quarter).

Apprenticeship tax and flat-rate payroll tax

Guinea has implemented an apprenticeship tax which is applicable to employers with less than 30 workers. The amount is calculated as a 2% tax on the total payroll cost and is only payable by employers. An exemption applies to companies subject to a 1.5% professional training contribution.

An additional flat-rate payroll tax (Versement forfaitaire sur les salaires) is defined in Article 201 of the General Tax Code of Guinea, adding another obligation for employers. The flat-rate tax of 6% of the total amount of paid salaries and allowances (including benefits in cash or in kind), less the amount of contributions paid for family benefits. The tax is paid monthly. Certain companies are exempt from payment.

Voluntary benefits and bonuses

While not mandatory as in some other countries in the region, a 13th-month salary is commonly paid, typically along with December salaries. It is often equal to one full monthly salary.
Private health insurance is also common in Guinea. Transport allowance and housing allowance are also commonly provided in senior roles.

What hiring in Guinea really looks like

According to Q2 2025 data published by the National Statistics Institute, certain sectors show greater hiring activity than others (based on newly created jobs by businesses during the period in question). These are primarily Commerce (almost 50% of all new jobs), Services (around 20%) and Construction (about 10%). However, the data simply shows particular trends during a specific period, while the country’s mining sector (one of the largest producers of Bauxite worldwide) remains its most significant industry and primary driver of the economy. Other growing sectors include agriculture, telecommunications, construction and services.

Hiring foreign employees under an EOR in Guinea

Employer-sponsored work authorization is required for all foreign nationals. Our local experts highlight that the process is not overly difficult, assuming all required documentation is available, with the key document being the French employment contract.

Typically, the first step is obtaining an entry visa (if the employee is outside Guinea), which usually takes a week or two and a written employment contract is required for it. The second step is the actual work permit process (through the Ministry of Labor and Social Service), which takes between four and six weeks and requires the employer to demonstrate the inability to source an appropriate candidate from the local labor market.

Guinea categorizes work permits by the role level (junior, middle management, executive, etc.). The category drives the administrative government fee and does not impact the complexity of the process beyond the cost. Granted permits are typically valid for a year and can be renewed. The local laws limit the duration of contracts for foreign hires to a maximum of four years (including renewals).

How an Employer of Record, like Rivermate can help with work permits in Guinea

Employment contracts and registration of employment

Employment contracts in Guinea must be concluded in French, which is the official language. Both fixed-term and indefinite contracts are possible. In case of fixed-term contracts, the maximum term is set at 2 years, including any renewals. Employers should also be aware of the requirement that foreigners’ employment contracts must reference the applicable work permit as well. The employment registration (following contract signing) is performed electronically and is a straightforward process.

Probationary periods

Probationary clauses in Guinea must be included in the contract or in a separate letter. The maximum duration of a probationary period is capped at one month for general staff and three months for executive-level roles.

Terminations and notice periods

Proper documentation is required for all terminations; a mutual termination agreement is the preferred separation route, provided both parties agree to the terms and sign in the presence of a Labor Inspector.
Notice periods depend on the role and can vary from one month (for entry-level roles), two months (supervisors) and up to three months (managerial roles).
Before a dismissal, the employee must be summoned to a meeting with at least five days' notice. Any decision to actually dismiss the employee must be made at least 3 days after that interview.

Benefits of hiring employees through an EOR in Guinea

As a potential employer in Guinea, you may be wondering if setting up an entity or using an EOR would be a better solution for your hiring needs. However, setting up a new entity and navigating through the local labor legislation, payroll processing, taxes and mandatory benefits administration may prove to be too lengthy, complex and costly, particularly if you are considering just one or two hires. On top of this, ensuring that the whole process is completed efficiently and compliantly to avoid losing a candidate may prove to be too risky.
An Employer of Record, like Rivermate, provides you with a faster and more cost-effective solution. You can hire your employees in Guinea using our existing infrastructure and expert knowledge. As the legal employer of record, we will handle all the employment steps, from employee onboarding to termination.
