Explore standard working hours and overtime regulations in Venezuela

Updated on April 24, 2025

Venezuelan labor law establishes a framework for working hours, overtime, and rest periods to protect employees' well-being and ensure fair compensation. Employers operating in Venezuela must adhere to these regulations to maintain compliance and foster a positive work environment. Understanding the nuances of these laws is crucial for effective workforce management and avoiding potential legal issues.

Standard Working Hours and Workweek Structure

The standard legal working week in Venezuela is 40 hours, typically distributed over five days. The maximum daily working hours are eight. There are three types of workdays:

  • Daytime shift (Diurna): Between 5:00 a.m. and 7:00 p.m.
  • Nighttime shift (Nocturna): Between 7:00 p.m. and 5:00 a.m.
  • Mixed shift (Mixta): Includes both daytime and nighttime hours, but nighttime hours cannot exceed four.
Workday Type Time Frame Maximum Daily Hours Maximum Weekly Hours

Overtime Regulations and Compensation Requirements

Any work performed beyond the standard daily or weekly hours is considered overtime. Overtime work must be authorized by the employer and is subject to specific limitations. The maximum overtime allowed is 10 hours per week and 100 hours per year.

Overtime compensation in Venezuela is calculated as follows:

  • Daytime Overtime: A surcharge of 50% on top of the normal hourly wage.
  • Nighttime Overtime: A surcharge of 75% on top of the normal hourly wage.
  • Overtime on Rest Days or Holidays: A surcharge of 75% on top of the normal hourly wage, plus payment for the rest day or holiday itself.
Overtime Type Surcharge on Normal Wage
Daytime Overtime 50%
Nighttime Overtime 75%
Rest Day/Holiday Overtime 75% + Rest Day/Holiday

Rest Periods and Break Entitlements

Employees are entitled to a minimum rest period of one hour during the workday for meals and rest. In addition, employees are entitled to a minimum continuous rest period of 36 hours per week, typically on Sundays.

Night Shift and Weekend Work Regulations

Night shifts are subject to stricter regulations due to the potential impact on employees' health and well-being. The maximum daily working hours for a nighttime shift are seven, and the maximum weekly working hours are 35. Nighttime work also requires a higher rate of pay, as detailed in the overtime section. Work on weekends (Saturdays and Sundays) is generally restricted, with Sunday being the standard rest day. If work is required on a weekend, employees are entitled to overtime pay and compensatory time off.

Working Time Recording Obligations for Employers

Employers in Venezuela are legally obligated to maintain accurate records of employees' working hours, including regular hours, overtime hours, and rest periods. These records must be kept for a specified period and be available for inspection by labor authorities. Failure to comply with these record-keeping requirements can result in penalties. Employers must also provide employees with pay stubs that clearly detail their wages, overtime pay, and any deductions.
