Standard working hours

The Paraguayan Labor Code establishes regulations regarding working hours, ensuring fair treatment for employees. Here's a breakdown of the key points:

The standard workweek in Paraguay is 48 hours.

The standard workday in Paraguay is 8 hours.

Workers with mixed schedules (day and night) cannot exceed 45 hours per week, with a daily limit of 7.5 hours.

These limitations are important to note as they ensure the fair treatment of employees and adherence to labor laws.

Overtime

In Paraguay, overtime work is regulated by the Ministry of Labor, Employment and Social Security. There are specific rules and compensation rates for overtime work.

Employees are not allowed to work more than 3 hours of overtime per day, and a maximum of 9 hours per week. The total working hours, including overtime, cannot exceed 11 hours per day.

Overtime work is compensated at a premium rate depending on the time worked. For daytime overtime during regular hours, the compensation is 1.5 times the regular salary. For nighttime overtime and on public holidays, the compensation is double the regular salary.

Rest periods and breaks

In Paraguay, labor law mandates rest periods and breaks to ensure worker well-being and productivity.

All workers are entitled to a minimum of 10 consecutive hours of daily rest between the end of one workday and the beginning of the next.

The Labour Code requires that daily working hours be divided into at least two equal parts, with a rest interval of at least 30 minutes. This break should be taken for meal consumption and relaxation.

There are exceptions for agricultural workers and domestic workers. These workers cannot be forced to work more than 12 hours per day without a rest break of one and a half hours during the workday.

Paraguayan law guarantees all workers one day of weekly rest, typically on Sundays.

Night shift and weekend regulations

Paraguay's labor laws provide a structure for night and weekend work, safeguarding employee rights and advocating for equitable working conditions.

Night work is defined as any work performed between 10:00 PM and 6:00 AM. The maximum legal duration for night work is 7 hours per night. Night workers are entitled to a 25% surcharge on their regular salary for each hour worked at night. Pregnant women, women who recently gave birth, and minors under 18 years old cannot be employed for night work.

Sundays and official holidays are considered rest days for employees. However, certain sectors, with prior authorization from the Ministry of Labor, Employment and Social Security (MTESS), can operate on Sundays and holidays. These include essential services, entertainment industries, and businesses with high customer demand. Weekend work (Sunday or holiday) requires a 100% surcharge on top of the regular salary. Workers can opt for compensatory rest instead of the surcharge, receiving an additional day of paid leave. All employees are entitled to at least one uninterrupted rest day per week, which typically falls on Sunday.
