Learn about employment contracts and agreements in Armenia

Updated on April 24, 2025

Employment agreements are fundamental to establishing a legally sound and productive working relationship in Armenia. These contracts outline the rights, responsibilities, and obligations of both the employer and the employee, ensuring clarity and protection for all parties involved. Understanding the nuances of Armenian labor law regarding employment agreements is crucial for businesses operating in the country to maintain compliance and foster positive employee relations.

Armenian labor law specifies various requirements for employment contracts, covering aspects such as contract types, essential clauses, probationary periods, confidentiality, non-compete obligations, and termination procedures. Adhering to these regulations is essential for avoiding legal disputes and ensuring fair treatment of employees.

Types of Employment Agreements in Armenia

Armenian labor law recognizes two primary types of employment agreements: fixed-term and indefinite-term contracts.

Contract Type Description
Fixed-Term Contract This type of contract specifies a definite period of employment, with a predetermined start and end date. Fixed-term contracts are generally permissible when the nature of the work is temporary or seasonal, or when the employment relationship is established for a specific project. The maximum duration of a fixed-term contract, including renewals, is generally five years, except as otherwise provided by law.
Indefinite-Term Contract This type of contract does not specify an end date and continues until either the employer or the employee terminates the agreement in accordance with Armenian labor law. Indefinite-term contracts provide more job security for employees and are the standard form of employment agreement in Armenia.

Essential Clauses Required in Employment Contracts

Armenian labor law mandates that certain clauses be included in all employment agreements to ensure clarity and protect the rights of both employers and employees. These essential clauses typically include:

  • Parties to the Agreement: Clearly identify the employer and the employee, including their full legal names and addresses.
  • Job Title and Description: Specify the employee's job title and provide a detailed description of their duties and responsibilities.
  • Start Date: Indicate the date on which the employment relationship commences.
  • Place of Work: Specify the location where the employee will primarily perform their duties.
  • Working Hours: Define the employee's regular working hours, including the start and end times, as well as any provisions for overtime work.
  • Compensation: Clearly state the employee's salary or wage, the payment schedule, and any applicable bonuses or allowances.
  • Leave Entitlements: Outline the employee's entitlements to annual leave, sick leave, and other types of leave, in accordance with Armenian labor law.
  • Termination Conditions: Specify the conditions under which the employment agreement may be terminated by either party, including notice periods and severance pay requirements.
  • Social Security Contributions: Specify the amount of social security contributions to be paid by both the employer and the employee.
  • Governing Law: State that the employment agreement is governed by the laws of Armenia.

Probationary Period Regulations and Practices

Armenian labor law allows for a probationary period at the beginning of an employment relationship, during which the employer can assess the employee's suitability for the position.

  • The probationary period must be stipulated in the employment agreement and cannot exceed three months.
  • During the probationary period, the employer can terminate the employment agreement if the employee is deemed unsuitable, provided that the employee is given at least three days' written notice.
  • If the employee successfully completes the probationary period, their employment continues under the terms of the employment agreement.

Confidentiality and Non-Compete Clauses

Employers in Armenia may include confidentiality and non-compete clauses in employment agreements to protect their business interests.

  • Confidentiality Clauses: These clauses prohibit employees from disclosing confidential information about the employer's business, such as trade secrets, customer lists, and financial data, both during and after their employment.
  • Non-Compete Clauses: These clauses restrict employees from working for a competitor or starting a competing business for a specified period after their employment ends.
    • Non-compete clauses must be reasonable in scope and duration to be enforceable.
    • Armenian courts will typically consider factors such as the nature of the employee's position, the geographic area covered by the restriction, and the length of the restriction when determining the enforceability of a non-compete clause.
    • The maximum duration of a non-compete clause is generally one year.

Contract Modification and Termination Requirements

Employment agreements in Armenia can be modified by mutual agreement between the employer and the employee. Any modifications must be in writing and signed by both parties.

Termination of an employment agreement can occur under various circumstances, including:

  • Mutual Agreement: The employer and the employee can agree to terminate the employment agreement at any time.
  • Employee Resignation: The employee can terminate the employment agreement by providing the employer with written notice, typically two weeks in advance.
  • Employer Termination: The employer can terminate the employment agreement for various reasons, such as employee misconduct, poor performance, or redundancy.
    • In some cases, the employer may be required to provide the employee with severance pay upon termination.
    • The amount of severance pay depends on the reason for termination and the employee's length of service.
  • Expiration of Fixed-Term Contract: A fixed-term employment agreement automatically terminates upon the expiration of its term.
