Working hours Article 241 of Official Gazette No. 731 (September 2026): A maximum legal working week of 40 hours.

Mandatory rest period 24 consecutive hours of rest per week.
Overtime Article 244 of Official Gazette No. 731 (September 2026): Overtime is paid at an increased rate set by collective agreement or establishment agreement.
Annual leave 2 working days of paid leave per month of service. After one year, this is 24 days. Employees receive 100% of their regular wages during their leave. A minimum of six leave days must be taken per annum. Leave allocations may be set by a collective agreement or employment contract, but must meet at least the statutory limits.
Sick leave Article 114 of Official Gazette No. 731 (September 2026):
Illness certified by a medical professional suspends the employment contract for up to a period of six months. The Labor Code does not prescribe the number of sick days that can be given per annum as per a collective agreement or employment contract.
Paid maternity leave Article 277 of Official Gazette No. 731 (September 2026): Every woman has the right to suspend her employment contract for 18 consecutive weeks, including 12 weeks following childbirth. The female employee is entitled to a special assistance scheme to ensure both her subsistence and care under the conditions provided for by social security regulations.
Severance pay For ‘no-fault’ dismissals, employees with at least 12 months of service, are entitled to severance pay as follows: Year 1- 5 of service: 25% of average monthly salary per year. Years 6-10 of service: 30% of average monthly salary per year. Years 11+ of service: 40% of average monthly salary per year.
13th/14th salary payment Not required, unless stipulated in a collective agreement or employment contract

Important update: Senegal has implemented a new labor code

In September 2026, a new labor code was promulgated by the President of the Republic on Thursday, September 3, 2026 under number 2026-18, and then published in the Official Journal of the Republic of Senegal on Thursday, September 17, 2026. This is the first time in three decades that Senegal has made major changes to its Labor Code. This new Code requires significant adaptation from employers and the challenge will be translating the new legislation into daily business practice.

Several changes are already reflected in this guide, however clearer guidelines will be issued in the coming months by official decrees and statutes. During the transition phase, it is critical for employers to get clarity from local experts about provisions in Senegal’s New Labor Code.

What hiring in Senegal is really like

Understanding salary benchmarks and statutory contributions is useful, but they don’t provide a complete picture. We spoke to local expert, Audrey Bower, who works directly with clients in the Senegalese market. Her insights provided a glimpse into what hiring in Senegal is really like.

According to Audrey, hiring in Senegal is not complicated but employers must respect the employment regulations. Where contracts exceed three months in duration, they must be registered with the Labor Office. Authorities must approve work contracts and while this can take longer than clients would like, they are almost always approved. Without any challenges, the process can be concluded in 2 to 4 weeks.

The practical challenge is that government processing can be slow and requires follow-up. The EOR provider may need to call the Labor Office directly, instead of waiting for a formal notification. Having someone on the ground in Senegal to do these follow-ups can make a real difference to how smoothly the process moves along.

Expat hiring requires additional documentation and a separate registration process through the Ministry of Labor. In Audrey’s experience, this can take between 2 and 8 weeks. The immigration process is straightforward, with most workers obtaining their visa on arrival and while waiting for contract approval, the employee may start work. One point was highlighted: Employers should not confuse the work permit with the residence permit. An authorization to work will not automatically give an employee the right to live in Senegal.

The main practical requirement for the Senegalese hiring market is sticking closely to employment regulations while exercising patience. Having someone on the ground who can maintain communication with authorities is definitely an advantage.

Legislative Reform (September 2026): According to Senegal’s New Labor Code, Article 105, The Director General of Labor and Social Security must receive foreign work contracts and has seven days to approve the contract. After this period, his silence constitutes approval.

Sending foreign nationals to Senegal

Drawing from the perspective of our local expert, the following points are important to know if you’re sending talent to Senegal.

  • Most nationalities enter Senegal and have their work visa granted upon arrival. Only certain nationalities without a local representative, will need to apply for their visa outside of the country.
  • Where a visa must be obtained before entry, it takes up to three weeks.
  • Most nationalities can enter the country for 30 days; some for 90 days.
  • Workers initially granted 30 days can receive an extension of up to six months. After six months, a residence permit must be obtained.
  • For workers who were granted a 90-day entry period, they can obtain a residence permit after that time, or they will need to leave and re-enter the country again.
  • The work permit process and the residence permit process are different. A work permit does not allow you to live in Senegal automatically.
  • Expat contracts are generally fixed-term contracts that cannot be extended beyond 2 years (including renewals).

Mitigating compliance risks in Senegal

Employment contracts

Contracts in Senegal must be drafted in French and follow the stipulations of the local employment regulations. While indefinite-term contracts can legally be verbal, fixed-term contracts must be in writing. Also, employment contracts have to be registered with the Labor Office or Ministry of Labor. In practice, this means formal contracts cannot be verbal if they last longer than three months.

Probation periods

Probation periods are allowed in Senegal to test whether an employee is a good fit. However, they are not mandatory and can be excluded. The maximum period is six months, including renewals. The exact structure depends on the employee’s job level and how they are paid.

The contract must be in writing and sent to the Labor Inspectorate before work begins.

Terminations

It is your right as the client to terminate an employment contract in Senegal as long as the termination reason is valid and legally defensible. The entire process (regardless of the reason) must follow a structured procedure, which the EOR provider can handle for you. When the termination is through no fault of the employee, but for operational or economic reasons, then they will be entitled to a severance payment. This payment will be based on their years of service.
