Vacation and Leave Policies

Understand the regulations on vacation and other types of leave in Mongolia

Holiday leave

In Mongolia, the Labor Law, enacted in 1999 and regularly updated, dictates the vacation leave entitlements for employees.

Basic Entitlement

Every employee is entitled to a minimum of 15 working days of paid annual leave per year. However, this increases to 20 working days for employees under the age of 18.

Additional Leave Based on Seniority

The Labor Law also grants additional paid annual leave days based on the duration of service with the employer:

  • 3 additional days for 6-10 years of service
  • 5 additional days for 11-15 years of service
  • 7 additional days for 16-20 years of service
  • 9 additional days for 21-25 years of service
  • 11 additional days for 26-31 years of service
  • 14 additional days for 32 or more years of service

Other Important Considerations

Every year, employers must approve an annual vacation schedule, considering employee requests while ensuring normal business operations. Employees are entitled to at least 10 consecutive calendar days of leave as part of their annual leave entitlement.

Part-time employees receive prorated annual leave based on their hours worked. Additionally, employees on certain types of leave, such as maternity leave or temporary disability leave, continue to accrue their annual vacation leave.

Types of leave

In Mongolia, the Labor Law provides several types of leave for employees.

Annual Paid Leave

Employees are granted 15 working days of paid annual leave. However, employees under the age of 18 receive 20 working days. Additional annual leave days are provided based on the length of employment. For instance, employees with 6-10 years of employment are entitled to 3 extra working days, those with 11-15 years of employment get 5 extra days, and those with over 15 years of employment receive 7 extra days. This leave can be used for personal or family reasons.

Sick Leave

In case of illness or injury, employees are entitled to paid sick leave. The amount of sick leave is determined by the severity and length of the illness, as certified by a doctor. Depending on the length of employment and the severity of the illness, employees are entitled to a part of their salary while on sick leave.

Maternity Leave

Female employees are entitled to 120 days of paid maternity leave, divided into 60 prenatal and 60 postnatal days. In case of multiple births or medical complications, this may be extended by up to 4 weeks. After the period of maternity leave, either parent can take further unpaid leave until the child reaches the age of 3.

Paternity Leave

Fathers have the right to 5 working days of paid paternity leave following the birth of a child.

Marriage Leave

Employees are entitled to 5 working days of paid marriage leave.

Unpaid Leave

Employees may request unpaid leave for personal reasons. However, the approval of unpaid leave is at the employer's discretion.

Other Types of Leave

The Labor Law of Mongolia also allows for other types of leave depending on specific circumstances. These include study leave for employees who wish to continue their education, and compassionate or bereavement leave in the event of the death of a family member.

It's important to note that this is a general overview of leave entitlements in Mongolia. Terms and conditions for specific types of leave might vary according to collective bargaining agreements or individual employment contracts.
